The meal break: applicable requirements, received cover and a real work boundary
The foreman calls suppliers while eating, then counts that period as a break. The afternoon plan still waits, and the next day repeats the same pattern. He needs a meal-break arrangement with actual cover, not another instruction to squeeze work into the last five minutes of lunch.

Arrange a genuine meal period under the requirements and employment arrangements that apply to you. Keep routine work and afternoon planning outside it where the arrangement provides a break from work. A twenty-minute phone-free pause is not a universal meal-break rule. Eating while answering instructions does not automatically make the period free from work or settle how it must be recorded.
Make the break workable instead of filling it
- Confirm the applicable requirements. For employees covered by BC's meal-break provisions, the Act requires at least half an hour before work exceeds five consecutive hours, and required work or availability counts as time worked. Exemptions apply, including managers as defined by the Regulation. Confirm your actual coverage and arrangement with the responsible employment adviser; do not assign entitlement from a job title alone.
- Arrange the site's received cover. Identify who handles the responsibilities that must continue, their actual authority and the necessary contact route. Check their availability and hand over current matters before the meal period. The same break time as every crew may be impractical for required cover. Discuss recurring interruptions rather than treating a solitary phone on silent as a complete site arrangement.
- Keep routine tasks out of the break. Use a suitable designated meal setting under the site arrangements. Move ordinary supplier calls, report writing and afternoon planning to their own work periods. Follow the actual response and recording process if work or required availability occurs. Do not rename a work conversation a reset or shorten a required meal period because the next meeting starts sooner.
- Restart with a brief work check. After the break, receive relevant cover information and check changed afternoon conditions. Confirm the next action and unresolved answers during work time. Review whether the arrangement actually provides its intended break and coverage. A meal period is not a guarantee of restored alertness; concerns about fatigue or fitness for work still need the appropriate workplace response.
Common mistakes
- Using twenty minutes as a universal meal-break entitlement.
- Calling required phone availability a work-free period.
- Putting afternoon planning inside a required break.
- Assuming a meal pause resolves fatigue concerns.
Action list
Agree a meal period with
- Actual legal coverage and employment arrangement.
- Suitable duration, timing and meal setting.
- Received cover and necessary response routes.
- Routine tasks assigned separate working time.
- Accurate recording and follow-up for interruptions.
Check your understanding
The foreman writes the afternoon plan during the last five minutes of a required meal break. Is that automatically a work-free break?
